What happens if you die without a will in Ireland?

If you die without a valid will, your estate is distributed under Ireland's intestacy rules rather than according to instructions in a will. For parents, guardianship can also require separate legal consideration, particularly where no surviving guardian has parental responsibility.

Common questions

Can a DIY will be legally valid in Ireland?
Yes. A solicitor is not a statutory requirement for every will. The document must satisfy the formal requirements in section 78 of the Succession Act 1965, including the signing and witnessing requirements.
Do I still need witnesses?
Yes. The testator must sign or acknowledge the signature in the presence of two witnesses present at the same time. Each witness must then sign in the testator's presence.
Is this suitable for complex estates?
No. If you have complex assets, significant tax-planning needs, foreign property, blended-family circumstances or a likely dispute, you should use a solicitor.
